Application Terms and Conditions


Your privacy is important

The application “BossBill” (Application) is owned and operated by BossBill Pty Ltd (ACN 693 936 337) (we, our or us). These terms and conditions (Terms and Conditions) relate to the Application and our provision, via the Application, of:

These Terms and Conditions form a legally binding agreement between you and us. You acknowledge and agree that these Terms and Conditions apply to your access to, and use of, the Application. By accessing and using the Application, you agree to the terms of these Terms and Conditions (as amended from time to time). If you do not accept these Terms and Conditions, then you must not access or use the Application.

By visiting, accessing or using the Application, you acknowledge and agree that you:

Intellectual Property

You hereby grant us a worldwide, royalty-free, non-exclusive and revocable licence to use the Information for the purpose of us making the Application available and maintaining the Application to assist in the provision of medical billing services.

Other than the Information:

May not be used without our prior written consent or the prior written consent of our licensors.

You indemnify us against any loss, costs, expenses, claims or damages for or in relation to loss of revenue, profits, savings, chance, business opportunity, goodwill or reputation, including in relation to or as a consequence of you breaching the above.

Payment Billing

Subscription Details

Our app offers the following subscription plans:

Subscriptions automatically renew at the end of each billing cycle (monthly) unless cancelled before the renewal date.

You may cancel your subscription at any time through:

To avoid charges for the next billing cycle, cancellation must be completed at least 24 hours before the renewal date.

Subscription charges already processed are non-refundable, including after account deletion. Refunds are subject to the Apple App Store and Google Play Store refund policies.

Our Role

The Application is solely for administrative purposes only to assist in the processing and management of medical bills. To facilitate this purpose, the Application includes content and services provided to us by other third parties (Third Party Content). We have not performed any independent investigations of the Third Party Content and, as such, we do not and are not able to recommend or endorse the Third Party Content. In respect of Third Party Content provided to us by or in relation to any person, business, company or organisation who has access to, or uses, the Application (Application Users), we do not and are not able to confirm that any of that information is accurate.

We may also collect personal information about you from third parties. For example, we may collect personal information about you from service providers, related entities, business partners and other third parties, including, without limitation, third parties handling Application support enquiries or providing payment processing or marketing services.

You rely on Third Party Content completely at your own risk. You may be subject to other terms and conditions imposed by a third party in connection with the Application. You should consider those terms and conditions at your own risk.

Our role in making the Application available and maintaining the Application does not constitute medical advice or an endorsement or recommendation of any kind, and you are counselled to consider whether the information, suggestions and opinions expressed in the Application are appropriate to your own personal circumstances.

We cannot guarantee that the Application will be suitable, compatible, or successful for an Application User, or that the Application will otherwise meet your requirements and commercial objectives.

To the maximum extent permitted by law:

Under and in accordance with the Health Insurance Act 1973 (Cth), practitioners must ensure compliance with all requirements set out in that act. Each Application User is solely responsible and liable for the accuracy of all Medicare item number billings made under their provider number, irrespective as to whether the Application provides a suggested Medicare item number. To the maximum extent permitted by law, we are not responsible for any Medicare item number billings undertaken through the Application and in no event shall we be liable for any direct or indirect loss, damage or expense, no matter how caused, which may be suffered due to the accuracy of any Medicare item number billings.

You should consider the relevance and applicability of a Medicare item number billing, including any suggestion made by the Application, before proceeding with the billing of any Medicare item number. If you are unsure of the applicability of a Medicare item number in connection with medical services provided by you, you should contact askmbs@health.gov.au before proceeding with any billing through the Application.

We will not be involved or provide commentary in any Medicare audits conducted in respect of or in any way in connection with an Application User. Any Medicare audit conducted in respect of or in any way in connection with an Application User will remain at all times solely the responsibility of the Application User.

Service availability

While we undertake reasonable endeavours to ensure the Application is always available, it is possible that on occasions the Application may be unavailable to permit maintenance or other development activity to take place.

If the Application will be interrupted for extended periods of time and will affect the services we provide to you, we will use reasonable endeavours to notify you of such interruption. However, we do not represent, warrant or guarantee that the Application will be available at all times.

Contributions

A payment made by an Application User or any other individual or organisation to us through the Application as a gesture of goodwill and support for the Application (Contribution) is non-refundable, and does not entitle you to any benefits, rewards, or privileges.

You acknowledge that we will not be held liable for any loss or damage (including consequential loss or damage) arising from a Contribution to us, or any disputes, claims, or refunds that may arise from it.

Term

We may terminate these Terms and Conditions, including your registered account and access to the Application if you breach any provision of these Terms and Conditions or otherwise in our discretion, without the need to provide reasons.

Privacy, Disclosure and Consent

The privacy policy sets out our practices regarding the collection, use, and disclosure of personal information through the Application (Privacy Policy). The Privacy Policy is available at https://app.bossbill.com.au/privacy-policy.

General

You may not assign or transfer any rights that you may have in respect of the Application to any other person without our prior written consent.

We reserve the right to amend these Terms and Conditions, any content or feature of the Application and the material available through the Application from time to time and without notice to you. Subject to any express statement by us to the contrary, any amendments shall be effective immediately upon being made available to the Application.

The terms of these Terms and Conditions are governed by the laws applicable in the State of South Australia. You irrevocably submit to the exclusive jurisdiction of the courts of South Australia and the division of the Federal Court of Australia in that jurisdiction, and the courts of appeal from them. You may not object to the jurisdiction of any of those courts on the ground that it is an inconvenient forum or that it does not have jurisdiction.

To the maximum extent permitted by law, all other warranties or conditions which are not guaranteed by law are expressly excluded, including but not limited to liability for loss of expectations, loss of profits, incidental or consequential loss or damage caused by breach of any express or implied warranty or condition.

Each provision of these Terms and Conditions must be read down to the extent necessary to be valid and if it cannot be read down to that extent, it must be severed.
